Apr 22 - California Supreme Court Agrees to Hear Plastic Bag Case

The California Supreme Court anounced today that it will hear the City of Manhattan Beach's appeal of the suspension of their plastic bag ban ordinance. Manhattan Beach's plastic bag ban was suspended by a plastics industry financed lawsuit.

Californians Against Waste joined with Manhattan Beach in requesting that the State's highest court considering overturning the suspension of the ban.

The plastics industry has succeeded in temporarily blocking enforcement of several local plastic bag bans on the grounds that the jurisdictions failed to complete a full Environmental Impact Report (EIR) before adopting the bans.

However, new analysis by CAW and others confirm what common sense has long suspected: the environmental damage and threat posed by plastic bags is substantially greater than that posed by a shift to either reusable bags or paper bags.
